New Laws Scheduled for 2010.

California has no new laws scheduled for the first time in many years. This is great news for both notaries and education vendors alike.

Utah made a clarification about how a driving priviledge card is obtained.

Oregon adopted some major changes, which include:

  • Notary may accept the following as satisfactory evidence:
    1. a current driver’s license or identification card issued by any U.S. state
    2. a U.S. passport or a foreign passport
    3. a current U.S. military identification card
    4. a current identity card issued by a federally recognized Indian tribe
  • If one of the four new specific types of identification documents is not presented by a document signer, a Notary may accept a current identification document issued by the U.S. federal government or a state, county, municipal or other local government and containing the person’s photograph, signature and physical description.
  • A notary who is also an employee of a financial institution may no longer identify a customer of the financial institution using a signature card signed by the customer as one of the two forms necessary to identify the signer.
  • The Secretary of State may not set a fee for a notarial act that exceeds $10. Note: this does not raise fees that an Oregon Notary may charge, but specifies that any fee set by the Secretary of State cannot exceed $10.
  • A notary who is employed by a private entity may enter into an agreement with the employer where notary fees can be collected by the notary and passed on to the employer.
  • A public body may collect fees for notarial services performed by notaries employed by that public body.

North Dakota also made some significant changes:

  • A notary is prohibited from notarizing a petition on which his or her spouse has affixed their signature. N.D.C.C. § 44-06-13.1(b).
  • A notary is prohibited from notarizing a signature of an individual without first having obtained satisfactory evidence as to the signer’s identity unless he or she is personally known by the notary. N.D.C.C. § 44-06-13.1(k).
  • Made it clear a notary is subject to disciplinary proceedings for violating any provision of Chapter 44-06 in addition to those listed in N.D.C.C. § 44-06-13.1 and N.D.C.C. § 44-06-13.2(e).
